Free Oregon Non-Durable (General) Power of Attorney Form

Oregon’s whole rule sits inside one conditional clause, and getting on the right side of it is the job. An Oregon Non-Durable (General) Power of Attorney gives an agent authority over your financial affairs and limits how long that authority lasts. Oregon never adopted the Uniform Power of Attorney Act, so the rules live in a short run of sections at ORS 127.002 to 127.045.

Section 127.005 does almost all of the work, and it starts with an if.

Just a Writing Naming an Agent

The section speaks of a principal designating another person as an agent by a power of attorney in writing. It sets out no separate signing ceremony, names no witnesses and requires no notary. That is a low bar by any standard, and it means your drafting carries the whole load.

The Default Applies Only If You Stay Silent

Here is the conditional. Where a principal designates an agent in writing and the power of attorney does not contain words that otherwise delay or limit the period of time of its effectiveness, three things follow: the document becomes effective when executed and stays in effect until revoked by you or by its own terms, the agent’s powers are unaffected by the passage of time, and the agent’s powers are exercisable even though you become financially incapable. Add words that limit the period of effectiveness and you step outside all three.

Oregon Says Financially Incapable

The statute does not use incapacity or disability. Its term is financially incapable, and that is the phrase to work with when you draft. Section 127.005 also lets you provide that the document becomes effective at a specified future time, or on a future event or contingency such as your becoming financially incapable.

Because in Oregon silence is what produces the durable result. Most states that presume durability ask you to include an express provision terminating the document on incapacity. Oregon frames it differently: the default package in section 127.005(1) applies only where your document contains no words that delay or limit the period of time of its effectiveness. Writing those words is the entire mechanism.

That phrasing is also broader than a straight incapacity clause. Words that limit the period of time of effectiveness cover an end date, a defined task, or a stated event, as well as a provision ending the authority when you become financially incapable. An Oregon Non-Durable (General) Power of Attorney can use any of them, and there is no prescribed form of words to copy.

One consequence is worth planning around. Because the statute ties the default to the document’s own text, a template drafted for another state may carry durability language that does nothing useful in Oregon while omitting the limit you actually need. Read the finished draft for what it says about duration, not for whether it uses the word durable.

Section 127.005 also covers what happens where a document springs on financial incapability. If it does not designate anyone to make that determination, or nobody designated is willing or able, any physician may make it, and the determination must be in writing.

1. Put the appointment in writing and name your agent.
2. Describe the authority you are granting in detail, since Oregon publishes no statutory list of powers.
3. Write in words that limit the period of time of the document’s effectiveness.
4. Say plainly whether the authority ends if you become financially incapable, using the statute’s own term.
5. Add a successor agent and the conditions for them to act.
6. Sign and date the document.
7. Consider a notary acknowledgment even though section 127.005 does not call for one, since banks generally expect it.
