What Is a Georgia Power of Attorney?

A Georgia power of attorney (POA) allows you (the principal) to grant authority to another person (the agent) to act on your behalf in legal, financial, or health matters. The principal must be at least 18 years old and of sound mind when creating the document.

Under GA Code § 10-6B-4, all POAs in Georgia are presumed durable, meaning they remain valid even if you become incapacitated—unless stated otherwise.

How To Write a Power of Attorney in Georgia

Follow these steps to create a valid Georgia POA:

  1. Identify the parties: List the names and contact details of the principal and the agent. You may also include successor agents.
  2. Grant authority: Define the powers given to your agent, such as managing property, accessing accounts, or making healthcare decisions.
  3. Include special powers: Add any specific powers, like managing trusts, gifts, or beneficiary designations. See GA Code § 10-6B-40 for items requiring explicit authorization.
  4. Choose effectiveness: A POA becomes effective upon signing unless stated otherwise. See GA Code § 10-6B-9.
  5. Select durability: Georgia POAs are durable by default unless otherwise specified. If you prefer a non-durable POA, clearly state it in the document.
  6. Sign and notarize: The principal must sign before one witness and a notary public (GA Code § 10-6B-5).

Legal Requirements and Considerations for Georgia POAs

Signing

Under GA Code § 10-6B-5, a POA must be signed by the principal in the presence of one witness and a notary. Notarization ensures authenticity and helps prevent disputes.

Filing

Most POAs do not need to be filed. However, if the POA includes real estate authority, it must be recorded in the county land records per GA Code § 44-2-21.

Revocation

You can revoke your POA anytime by providing written notice to your agent. GA Code § 10-6B-10 outlines that revocation becomes effective once the agent receives notice. If your spouse is your agent, divorce or legal separation automatically ends their authority.

Termination

A POA ends when:

  • The principal or agent dies.
  • The principal revokes it.
  • The purpose is fulfilled.
  • A court declares it invalid.
  • The agent resigns or becomes incapacitated without a successor.
