What Is an Idaho Power of Attorney?

How to Write a Power of Attorney in Idaho

Follow these steps to draft a valid POA that aligns with Idaho law:

  1. List the principal and agent: Include full legal names and contact information. You may also appoint a successor agent.
  2. Grant general powers: Idaho Code §§ 15-12-204 to 15-12-216 outlines the general powers available to your agent, including managing property, finances, and investments.
  3. Add specific authorities: Certain powers—like gifting, trust creation, or beneficiary designation—require explicit permission under ID Code § 15-12-201.
  4. Include special instructions: Use this section to limit or expand your agent’s powers and specify any event that triggers revocation or termination.
  5. Set the effective date: A POA is effective immediately unless you specify another date or condition, per ID Code § 15-12-109. An Idaho power of attorney will remain valid after the principal’s incapacitation unless the document specifies otherwise.
  6. Review and sign: Review your terms, attach supporting documents, and sign before a notary public to validate the form.

Idaho Legal Considerations and Requirements

Notarization

Under ID Code § 15-12-105, a POA must be notarized for the signature to be presumed genuine. This ensures financial and legal institutions recognize the document as valid.

Filing

You don’t need to file a POA with the state unless it grants real estate authority. In that case, record it with the County Clerk and Recorder’s Office where the property is located.

Revocation

Per ID Code § 15-12-110, the principal may revoke a POA by written notice to the agent. Revocation can also occur automatically if:

  • The principal becomes incapacitated (non-durable POA). Powers of attorney in Idaho are durable by default.
  • A specific event in the agreement triggers termination.
  • The principal divorces their agent spouse.
  • The agent resigns or dies without a successor.

Actions taken in good faith before the agent receives notice of revocation remain legally valid.
