What Is an Illinois Power of Attorney?

An Illinois power of attorney (POA) lets you appoint another person (called an agent or attorney-in-fact) to make financial, medical, or legal decisions on your behalf.

Under the Illinois Power of Attorney Act (755 ILCS 45), the principal must be at least 18 years old, of sound mind, and voluntarily signing the document. Any POA created under coercion or undue influence is invalid.

Illinois recognizes several types of POAs, each allowing the principal to grant different powers to the agent. A valid POA ensures your financial and medical matters continue smoothly if you become incapacitated. In Illinois, a power of attorney is durable by default, meaning it survives the principal’s incapacity unless the document states otherwise.

Types of Power of Attorney in Illinois

How to Write a Power of Attorney in Illinois

Follow these steps to create a legally valid Illinois POA that complies with 755 ILCS 45:

  1. Name the parties: Include the full legal names and addresses of both the principal and agent.
  2. Grant powers: Choose which general powers you want to give your agent, such as managing finances, healthcare, or property.
  3. Add limitations: Specify any powers you want to restrict or special instructions for your agent.
  4. Set the effective date: Under 755 ILCS 45/2-4, a POA becomes effective immediately unless you specify another start date or triggering event.
  5. Sign and notarize: Review your form for accuracy, then sign before one witness and a notary public to make it valid.

Illinois Legal Requirements and Considerations

Notarization

For most POAs, Illinois law requires the principal’s signature to be witnessed by at least one adult and notarized. The witness and notary must be different people. A medical POA only requires one witness, but notarization is recommended for additional protection (755 ILCS 45/4-5.1).

Filing

Illinois does not require you to file a POA with the state. However, if it includes real estate powers, you must record the document with the county recorder of deeds where the property is located.

Revocation

The principal can revoke a POA at any time under 755 ILCS 45/2-5. Revocation must be communicated to the agent in writing or verbally. A POA is also automatically revoked upon divorce if the agent is the principal’s spouse.

Actions taken in good faith before the agent receives notice of revocation remain valid. The agent may also resign by providing written notice to the principal.
