How to Write a Power of Attorney for Kansas

Writing a Kansas POA requires including the correct details and following state law. Here’s how:

  1. Name the parties: Include the full legal names and addresses of the principal and agent.KS Stat § 58-653 allows you to appoint co-agents or successor agents.
  2. Give general authority: List which powers your agent has — financial, legal, medical, or otherwise. These can include property, tax, or healthcare decisions.
  3. Note special powers: For sensitive matters (trusts, gifts, or beneficiary designations), specify them clearly to comply withKS Stat § 58-654.
  4. Add specific instructions: Include special conditions or restrictions on the agent’s authority. If you don’t specify otherwise, Kansas law treats your POA as non-durable underKS Stat § 58-652 unless the document specifically states otherwise.
  5. Review and sign: Check all details carefully. Then sign and notarize your POA. Certain POAs, like medical ones, also allow two witnesses instead of a notary underKS Stat § 58-629.

Notarization

Kansas requires POAs to be notarized.KS Stat § 58-652 makes a notarized signature presumptively genuine.

Filing

While KS Stat § 58-652 notes that recording isn’t required, you must file a POA involving real estate in the county where the property is located (KS Stat § 58-2221).

Revocation

Either the principal or agent can revoke a POA.KS Stat § 58-657 and§ 58-659 outline termination rules, including principal revocation, agent resignation, or divorce from an agent who is the principal’s spouse. Acts taken in good faith after the revocation but before the agent receives notice are still valid.
