What Is a Kentucky Power of Attorney?

A Kentucky power of attorney (POA) is a legal agreement allowing one person (the agent) to make decisions or handle transactions on behalf of another (the principal). It operates under the Uniform Power of Attorney Act. The principal must be at least 18 years old and mentally competent when creating this document. A Kentucky power of attorney is considered durable unless it explicitly states otherwise.

How to Write a Power of Attorney for Kentucky

Follow these steps to write a valid Kentucky power of attorney:

  1. Name the agent and principal: Include the full legal names and addresses of both the principal and agent, as well as any successor agents.
  2. Grant general authority: Select which general powers you want your agent to have — such as banking, real estate, or business management.
  3. Add specific powers: You may grant additional authority for handling trusts, gifts, or beneficiaries. These are outlined under KY Rev Stat §§ 457.270–457.400.
  4. Include special instructions: Add any personal notes, medical preferences, or financial conditions you want to specify.
  5. Finalize and sign: Review your POA carefully. Once complete, sign it before a notary public or witnesses if required. Notarization is recommended under KY Rev Stat § 457.050.

Kentucky Power of Attorney Requirements & Legal Considerations

Notarization

Your POA should be notarized to make it enforceable. Under KY Rev Stat § 457.050, notarization makes the signature presumptively genuine. Certain POAs, such as medical ones, can also use witnesses instead.

Filing

Filing is generally not required unless the POA grants real estate authority. In that case,KY Rev Stat § 382.370 requires it to be filed with the County Clerk’s office where the property is located.

Agent Certification

Agents may use a certification form to confirm and clarify their powers under KY Rev Stat § 457.430. This optional form helps verify the agent’s authority when presenting the POA to third parties.

Revocation

Both the principal and agent can revoke the POA at any time.KY Rev Stat § 457.100 explains valid revocation methods, including written notice, resignation, or automatic revocation upon divorce or incapacitation (for non-durable POAs).
