Free Oklahoma Limited Power of Attorney Form

An Oklahoma limited power of attorney names an agent to act for you on a specific matter. Oklahoma’s Uniform Power of Attorney Act, in Title 58 starting at section 3001, governs it. House Bill 2548 enacted that act, effective November 1, 2021, and it replaced the state’s older Uniform Durable Power of Attorney Act.

Oklahoma splits its rules between the power of attorney act and the conveyancing title.

Your Signature Under the 2021 Act

You sign the document, or another individual signs your name in your conscious presence at your direction (58 O.S. § 3005). Any document drafted before November 2021 may follow the older act, so check which rules your template reflects.

A Notary Adds a Presumption

Once you acknowledge your signature before a notary public or other authorized official, the law presumes it genuine (58 O.S. § 3005). Then a person who accepts the acknowledged document in good faith may rely on that presumption, unless they know the signature is fake (58 O.S. § 3019).

Real Estate Follows Deed Rules

A power of attorney to convey real estate, or to sign or release a mortgage, must be executed, acknowledged, and recorded the way Title 16 requires for deeds and mortgages. The document then goes on record in the county where the land sits (16 O.S. § 20). In practice, that means drafting it to deed standards from the start.

Homestead Property Has Its Own Recording Step

Title 16 adds a homestead rule. For an attorney-in-fact’s deed, mortgage, or contract affecting exempt homestead property to be valid, the power of attorney must go on record with the county clerk where that property sits. So if your home is involved, build that recording into the plan.

No. Under 16 O.S. § 20, the county can’t accept a deed, mortgage, or mortgage release your attorney-in-fact signs until the power of attorney sits on record in the same office. Until then, recording that deed has no effect for any purpose.

That rule protects buyers and lenders, who need to see the authority behind the signature. It also explains why a title company will usually ask for the power of attorney well before closing.

So for an Oklahoma limited power of attorney covering a sale or refinance, record the power of attorney first. The same section treats certain powers of attorney issued by a federal government agency as sufficiently recorded once officially published, but that exception won’t cover a personal document.

Settle the recording plan before you sign. Then follow this order:

1. Name the specific property, account, or transaction.
2. Confirm whether the task involves conveying land or a mortgage.
3. Sign it, or have someone sign your name while you’re present and directing it.
4. Have a notary public complete the acknowledgment.
5. Record it in the county where any land is located, before your agent’s deed goes to record.
6. Keep the recording information for the revocation you’ll file later.

Your Oklahoma limited power of attorney should be ready for the county clerk from day one. Include:

• The principal’s and attorney-in-fact’s full names
• The exact authority, with a legal description for any land
• Whether the authority covers homestead property
• A termination date, or the closing that ends the job
• Your signature, with a notary’s certificate attached

Drafting to deed standards pays off here. A document that already meets Title 16’s execution and acknowledgment rules can go straight to recording without a second signing. It also spares your agent a trip back to you if the clerk rejects the first version.
