What Is a Maine Power of Attorney?

A Maine power of attorney (POA) allows you to legally appoint an agent to make decisions on your behalf. This document is commonly used for financial or health care matters but can also apply to specific legal or personal decisions.

The principal (you) must be at least 18 years old and of sound mind to create a valid POA in Maine. Once signed, your agent gains legal authority to act according to the powers you grant.

A POA is an essential estate planning tool that ensures your affairs are managed even if you become unavailable or incapacitated.

Types of Powers of Attorney in Maine

Maine has adopted the Maine Uniform Power of Attorney Act, which governs how powers of attorney are created and enforced. The type of POA you choose determines the extent of your agent’s authority.

How to Write a Power of Attorney for Maine

Follow these steps to create a valid Maine POA that meets state law:

  1. Name the principal and agent: List the full legal names and addresses of both parties. You may also appoint a successor or co-agents.
  2. Define the powers granted: Specify the scope of authority the agent will have—such as financial, medical, or property management powers.
  3. Set the effective date and duration: Choose when the POA takes effect and when it will expire. By default, a Maine POA is durable, remaining valid even if you become incapacitated (ME Rev Stat § 5-904).
  4. Add conditions or limitations: Clearly describe any restrictions or special conditions related to your agent’s authority.
  5. Sign and notarize: The document must be signed and acknowledged before a notary public to be valid (ME Rev Stat § 5-905).

Legal Requirements and Considerations for Maine POAs

Duration

A Maine power of attorney remains effective until it’s revoked, expires under its own terms, or one of the termination conditions in ME Rev Stat § 5-910 occurs, or upon the principal’s incapacity if the POA is non-durable. Unless stated otherwise, all POAs in Maine are durable by default.

Termination

A POA ends automatically if:

  • The principal or agent dies
  • The agent becomes incapacitated or resigns
  • The principal revokes the POA
  • A court terminates it
  • A specified event or expiration date occurs

If a spouse is named as agent, the POA terminates upon divorce, annulment, or legal separation unless otherwise stated in the document.

Revocation

You can revoke your POA at any time by completing a revocation of power of attorney form. Sign and date the revocation, and deliver copies to your agent and any relevant institutions.

Your agent’s actions taken before receiving the revocation notice remain valid.

Filing

Depending on the powers granted, your POA may need to be filed with certain entities, such as your local land records office, if it involves real estate transactions.

Signing and Notarization

Under ME Rev Stat § 5-905, a POA must be signed and notarized to be legally enforceable. The principal must sign the document (or direct someone to sign in their conscious presence) before a notary public or another authorized official.
