What Is a Montana Minor (Child) Power of Attorney?

A Montana minor (child) power of attorney lets a parent or guardian delegate powers over a child’s care, custody, or property under MCA 72-5-103. It sits in the guardianship chapter of Montana’s probate laws, and the statute doesn’t require a court filing.

Montana Rules for Delegating Parental Powers

Six Months for Most Families

A parent or guardian can delegate these powers for a period not exceeding six months. After that, you’d sign a new document if care continues.

What You Can’t Hand Over

Still, you can’t delegate the power to consent to your child’s marriage or adoption. Those decisions remain with you.

Guardians Can Use It Too

A court-appointed guardian of a minor can also delegate under this section. The same limits apply, so the six-month cap and the marriage and adoption exclusions still hold.

No Six-Month Limit for Many Service Members

Montana lifts the six-month cap for three groups:

  • Active duty members of the US military
  • Montana National Guard members serving more than 180 continuous days on qualifying duty
  • Federal reserve members serving more than 180 continuous days on federal duty

Tip

If you’re in the Guard or reserves, check your orders before you pick dates. The longer term applies only when your service runs more than 180 continuous days on qualifying duty.

How Long Does a Montana Minor (Child) Power of Attorney Last?

Up to six months for most parents. A Montana minor (child) power of attorney can’t run longer unless you fall into one of the military groups above.

In that case, the statute simply removes the six-month limitation. So write the end date you want into the document, based on your deployment or service. Then, if your orders change, update the document to match.

How to Sign It in Montana

  1. Name yourself, each child, and the adult who will care for them.
  2. List the care, custody, or property powers you’re delegating.
  3. Pick dates within six months, or note your qualifying military service.
  4. Sign before a notary so schools and doctors can rely on it.
  5. Hand over the original, and tuck a copy in your own files.

What to Include in a Montana Form

  • Your name and relationship to the child
  • Each child’s full name and date of birth
  • The caregiver’s name, address, and phone number
  • The powers delegated
  • Start and end dates, or military service details
