What Is a North Carolina Minor (Child) Power of Attorney?

A North Carolina minor (child) power of attorney names an adult to look after your child and spells out what they may decide. For medical decisions, North Carolina has a specific statute: an authorization to consent to health care for a minor under G.S. Chapter 32A, Article 4.

Who Can Sign It

A custodial parent can grant an agent full power to consent to and authorize health care for the child. That power is as broad as the parent’s own.

One Firm Limit

However, the agent can’t consent to withholding or withdrawing life-sustaining procedures.

A Statutory Form

G.S. 32A-34 provides a statutory form for this authorization. The statute calls this a nonexclusive method, so it’s one option among others.

Same Effect as Your Own Consent

When the agent consents under the authorization, it has the same effect as if you were present and consenting yourself.

It Stays in Effect if You Can’t Act

The authorization isn’t affected if you later become incapacitated. As a result, it can still work in the situations where you’d need it most.

Tip

Hand your caregiver a copy for each provider. Health care practitioners are advised to keep a copy of the authorization in the child’s record. So having extras ready helps a clinic or hospital act quickly.

What About Non-Medical Decisions in North Carolina?

North Carolina’s statute covers health care only. It doesn’t set rules for delegating other parts of a child’s care, like school or daily decisions. So those parts of your document rest on your own written wishes.
