What Is a North Dakota Minor (Child) Power of Attorney?

A North Dakota minor (child) power of attorney lets a parent or guardian delegate powers over a child’s care, custody, or property under N.D.C.C. § 30.1-26-04. The North Dakota courts also offer a self-help form for it.

North Dakota Rules for Delegating Parental Powers

Six Months, No Longer

A parent or guardian can delegate these powers for a period not exceeding six months, so pick your end date with care. After that, you’d need a new document if care continues.

Marriage and Adoption Stay With You

The attorney-in-fact can take on most parental decisions. However, they can’t consent to the child’s marriage or adoption.

Parents and Guardians Alike

A child’s guardian can use this statute too, with the same six-month limit and the same exclusions.

Not a Court Order

According to the North Dakota courts, a power of attorney isn’t a court order. It also isn’t a guardianship or conservatorship.

Revocable at Any Time

The parent or guardian who signed it can revoke it at any time. The courts advise putting the revocation in writing.

Tip

North Dakota’s courts caution that medical providers, insurers, schools, and government agencies may not accept a power of attorney. So call ahead and ask what they need before you rely on it.

How Long Does a North Dakota Minor (Child) Power of Attorney Last?

No more than six months. A North Dakota minor (child) power of attorney can’t be written to last longer under § 30.1-26-04.

If your child needs care for a longer stretch, a court-appointed guardianship may fit better. In that case, the courts’ self-help center is a good place to start.

Meanwhile, the courts’ form gives you two choices. You can delegate all of your parental powers except marriage and adoption, or you can list only the specific powers you want to hand over.

  1. Enter your name, your child’s name, and the attorney-in-fact’s name.
  2. Choose whether to delegate all powers, except marriage and adoption, or only specific ones.
  3. Set an end date no more than six months after signing.
  4. Sign the form, and keep a copy for yourself.
  5. Share copies with the school and the child’s doctors.
