What Is an Ohio Minor (Child) Power of Attorney?

In Ohio, the statutory minor (child) power of attorney is a power of attorney for a residential grandparent under R.C. 3109.52. A parent, guardian, or custodian can use it to give a grandparent the child lives with authority over the child’s care.

Ohio’s statute applies to a grandparent of the child with whom the child is residing. It doesn’t cover other relatives or family friends.

What the Grandparent Can Do

The power of attorney can include the right to enroll the child in school and get educational and behavioral information from the district. It can also cover consent to school matters and to medical, psychological, or dental treatment.

What It Can’t Do

However, it can’t grant authority to consent to the child’s marriage or adoption. It also doesn’t affect your rights in any future custody proceeding.

A Related Option: the Caretaker Authorization Affidavit

Ohio also has a Caretaker Authorization Affidavit under R.C. 3109.65. The grandparent signs this one, and it’s meant for situations where the parent can’t sign a power of attorney. An Ohio notary must notarize the grandparent’s signature, and the affidavit gets filed with the juvenile court. Like the power of attorney, it doesn’t give the grandparent legal custody.

Tip

Mark the five-day filing deadline on your calendar before you sign. A notarized Ohio grandparent power of attorney still has to reach the juvenile court on time.

Does an Ohio Minor Power of Attorney Need a Notary and Court Filing?

Yes to both. The signatures on an Ohio minor (child) power of attorney must be notarized by an Ohio notary public.

You must also file your Ohio minor (child) power of attorney with the juvenile court within five days after it’s created. County court packets say to file in the county where the grandparent lives.

How to Set It Up in Ohio

  1. Confirm the child lives with the grandparent you’re naming.
  2. Complete the power of attorney using Ohio’s statutory form.
  3. Sign it before an Ohio notary public.
  4. File it with the juvenile court within five days.
  5. Give the grandparent a copy for the school and doctors.
