How South Dakota Law Handles Temporary Care

No General Delegation Statute

South Dakota doesn’t have a general statute setting rules for a parent’s power of attorney over a child’s care. As a result, there’s no state-set time limit or statutory form for most families.

A Common Mix-Up

Some sources cite SDCL 29A-5-210 as a six-month limit on parent delegations. However, that section actually covers a court’s appointment of a temporary guardian when an immediate need exists.

Naming a Guardian in Writing

Under SDCL 29A-5-202, a parent of an unmarried minor can nominate a guardian by will or other signed writing. A court still makes any appointment.

Tip

Because South Dakota doesn’t set a time limit for most parents, write a clear end date into your document. A defined window also makes it easier for schools and doctors to accept.

Special Rules for Deploying Service Members

South Dakota’s Uniform Deployed Parents Custody and Visitation Act, SDCL chapter 25-4B, adds a specific option. A deploying parent can use a South Dakota minor (child) power of attorney to delegate all or part of their custodial responsibility to an adult nonparent for the period of deployment.

That option applies only if no other parent has custodial responsibility, or if a court order currently bars the other parent’s contact with the child. In addition, the parent can revoke it by signing a revocation. If a court has already entered a custody or child support order, the power of attorney must be filed with that court within a reasonable time.

How to Prepare It in South Dakota

  2. Spell out which decisions the caregiver may make, like enrolling in school or approving treatment.
  3. Set a start date and a firm end date, or the deployment period.
  4. Sign before a notary so others can rely on it.
  5. If you’re deploying and a custody order exists, file the document with that court.
