What Is a Missouri Power of Attorney?

A Missouri power of attorney (POA) is a legal document that lets you (the principal) authorize another person (the agent) to act on your behalf in financial, medical, or legal matters.

You must be at least 18 years old and mentally competent to create a valid POA. This ensures the document reflects your intentions and that your agent can lawfully carry out your wishes if you become unable to do so.

Types of Power of Attorney in Missouri

Missouri offers different types of POA forms depending on your goals. Each type defines how much authority your agent will have and under what circumstances.

How to Write a Power of Attorney for Missouri

Follow these steps to create a valid Missouri power of attorney:

  1. Identify the principal and agent: Include the full names, addresses, and contact details of both parties.
  2. Grant general authority: Under MO Rev Stat § 404.714, you can grant your agent broad powers such as managing property, business interests, or financial accounts.
  3. Add specific powers and limitations: Include any unique powers or restrictions. For example, if you want your agent to make gifts or manage trust assets, these powers must be explicitly stated.
  4. Set the effective date: You can choose whether your POA takes effect immediately or upon a defined event, such as your incapacitation. Durable POAs remain valid even if you lose capacity, while non-durable POAs terminate in that case. You must include specific language making the POA durable since they are not durable by default under Missouri law.
  5. Sign and notarize: Under MO Rev Stat § 404.705(3), your POA must be signed by the principal and notarized to be presumed genuine. Notarization ensures your document will be accepted by banks and institutions.

Missouri Power of Attorney Legal Requirements and Considerations

Notarization

A Missouri power of attorney must be signed and notarized according to MO Rev Stat § 404.705(3). The notary acknowledgment validates the principal’s identity and confirms that the signature was made voluntarily.

Filing

Most POAs in Missouri don’t require filing. However, if your document grants real estate authority, it must be notarized and recorded with the recorder of deeds in the county where the property is located. Filing copies with healthcare providers or financial institutions is also recommended to ensure smooth recognition.

Revocation

You can revoke your POA at any time while you’re mentally competent. Under MO Rev Stat § 404.717, a POA ends when:

  • The document expires or reaches its stated termination date
  • You issue and deliver a written revocation notice to your agent. Acts done prior to receiving notice will generally remain valid.
  • You become incapacitated (if the POA is non-durable)
  • You pass away
  • Your agent is your spouse, and you file for divorce or legal separation, unless the document specifies otherwise

To formally end your agreement, you can complete a revocation of power of attorney form and distribute copies to your agent and relevant institutions.
