What Is a Nebraska Power of Attorney?

A Nebraska power of attorney (POA) allows you (the principal) to authorize another person (the agent) to handle legal, financial, or medical matters on your behalf.

This legal document is vital for estate planning. If you become incapacitated, your agent can make decisions and manage your affairs without court involvement. To ensure validity, you must create your POA while you’re of sound mind. Nebraska does not recognize POAs created after incapacitation, as defined by NE Code § 30-4002.

Types of Power of Attorney in Nebraska

Nebraska offers several types of POAs designed for different purposes. You can create a durable, non-durable, medical, or limited POA depending on your needs.

How to Write a Power of Attorney for Nebraska

To make your Nebraska POA legally valid, include these key details:

  • Principal and agent information: Full names and contact details for both parties.
  • Powers granted: Clearly outline what the agent can and cannot do.
  • Restrictions or conditions: Specify any limits on authority or duration.
  • Signatures: The document must be signed by the principal and notarized.

Under NE Code § 30-4004, a Nebraska POA is durable by default unless stated otherwise. You may also specify that it only takes effect upon a particular event, such as incapacitation.

If you prefer a medical POA, NE Code § 30-3401 and NE Code § 30-3410 outline its rules and duration. The healthcare agent’s authority continues until your death or until you revoke the form.

Legal Requirements and Considerations for Nebraska POAs

Duration

A Nebraska durable power of attorney remains valid from execution until the principal’s death or revocation, as stated in NE Code § 30-4004. However, you may customize the duration to include a specific start or end date.

Termination

A POA terminates under the conditions listed in NE Code § 30-4010, including:

  • The principal’s or agent’s death
  • The principal’s incapacitation (for non-durable POAs)
  • A written revocation notice
  • Fulfillment of the document’s purpose
  • Expiration date specified in the form
  • Divorce or separation when the agent is the principal’s spouse

Revocation

You can cancel your POA by completing a revocation of power of attorney and notifying your agent. Although Nebraska law doesn’t require written notice, a formal revocation prevents your agent from acting on your behalf after termination.

Filing

Filing is not required for most POAs in Nebraska. However, if your document concerns real estate transactions, you should record it with the Register of Deeds in your county.

Signing and Notarization

Under NE Code § 30-4005, the principal must sign the POA or direct another person to do so in their conscious presence. A notarized signature is required for legal authenticity and ensures the POA is presumed valid in court or by financial institutions.
