What Is a New Hampshire Power of Attorney?

Under NH Rev Stat § 564-E:104, a principal must be of sound mind and capable of understanding the document at the time it’s signed. Once created, the POA legally empowers the chosen agent to act in your best interest.

How to Write a Power of Attorney for New Hampshire

Follow these steps to ensure your POA meets New Hampshire legal standards:

  1. Include the principal’s information: Identify the principal and the agent with full legal names and addresses.
  2. Designate your agent: Under NH Rev Stat § 564-E:105, you can name one or more agents, as well as successor agents.
  3. Specify the powers granted: Clearly outline whether the agent’s authority is general or limited. You can authorize actions such as banking, investments, or healthcare management.
  4. Add the duration: A POA takes effect upon signing and remains valid until revoked, unless you specify a future activation date or an end condition. Powers of attorney in New Hampshire are durable by default, meaning they will continue in effect despite the principal’s incapacity.
  5. Sign and notarize the document: A POA must be signed by the principal and notarized. This ensures compliance with New Hampshire’s acknowledgment requirements.
  6. Include a disclosure statement: As required by NH Rev Stat § 564-E:301, principals must sign a disclosure statement confirming they understand the powers being granted.

Legal Requirements and Considerations for New Hampshire POAs

Duration

A POA is generally durable unless stated otherwise. If you include a specific condition or date for it to take effect, you may designate someone to confirm when that condition has occurred, such as a physician or judge.

Termination

According to NH Rev Stat § 564-E:110, a POA ends when:

  • The principal or agent dies
  • The agent resigns or becomes incapacitated
  • The principal revokes the POA
  • The non-durable POA ends upon the principal’s incapacitation
  • The POA fulfills its stated purpose

A POA naming a spouse as agent terminates automatically upon divorce or legal separation unless otherwise stated.

Revocation

The best way to revoke a POA is through a written, notarized statement. Use the revocation of power of attorney form to formally withdraw an agent’s authority and provide copies to all affected parties.

Filing

Most POAs don’t require filing. However, if your POA includes authority over real estate, you must record it with your local County Register of Deeds office.

Signing and Notarization

Per NH Rev Stat § 564-E:105, a POA must be signed by the principal or another person directed by them in their conscious presence, and acknowledged before a notary public or other authorized official.

Additionally, the agent must sign an acknowledgment under NH Rev Stat § 564-E:113 confirming acceptance of the appointment and duties.
