What Is a New Jersey Power of Attorney?

A New Jersey power of attorney (POA) is a legal document that lets someone act on your behalf for specific legal, financial, or medical purposes.

Under NJ Rev Stat § 46:2B-8.2, this document defines both the principal (the person granting authority) and the attorney-in-fact (the person receiving it). The POA ensures your affairs are handled according to your wishes if you’re unavailable or incapacitated.

POAs in NJ are not durable by default, so if the principal wants it to continue beyond incapacitation they will need to specify that.

Types of Power of Attorney in New Jersey

New Jersey law recognizes several POA types to meet different needs. Each serves a distinct function and has its own signing requirements.

How to Write a Power of Attorney for New Jersey

Creating a valid POA in New Jersey requires following a few key steps:

  1. Choose Your Agent: Select a trusted person to act on your behalf. According to NJ Rev Stat § 46:2B-8.7, your agent must be a competent adult at least 18 years old. You can also name a successor agent in case your first choice is unavailable.
  2. Create the Document: You don’t need a specific state-issued form, but your POA must comply with state law. A well-drafted document clearly describes your agent’s powers and responsibilities.
  3. Sign and Notarize: Most POAs must be signed in front of a notary public or other authorized official, as required by NJ Rev Stat § 46:2B-8.9. The notarization process itself is described under NJ Rev Stat § 46:14-2.1.
  4. Record the Document (If Applicable): Only record your POA if it relates to real estate. Under NJ Rev Stat § 46:16-1.1, real estate powers must be filed with the County Clerk where the property is located.
  5. Distribute Copies: Provide copies to your agent and relevant institutions, such as banks. Financial institutions may only reject a valid POA under limited circumstances outlined in NJ Rev Stat § 46:2B-13.
  6. Revoke When Needed: You can revoke your POA at any time while mentally competent.NJ Rev Stat § 46:2B-8.10 specifies that revocations must be written to remain legally binding. A non-durable POA automatically ends if you become incapacitated. You should deliver notice of the revocation to your agent as soon as possible.

Additional Legal Considerations

  • Durability: POAs in New Jersey are non-durable by default. To make it durable, include language such as “This power of attorney shall not be affected by subsequent disability or incapacity of the principal.”
  • Medical Authority: A medical power of attorney (proxy directive) falls under NJ Rev Stat § 26:2H-58 and can be combined with a living will to specify your treatment preferences.
  • Child Power of Attorney: Under NJ Rev Stat § 3B:12-39, a parent or guardian can temporarily delegate authority for up to one year, extendable in certain emergencies.
