What Is a New Mexico Power of Attorney?

A New Mexico power of attorney (POA) lets you (the principal) appoint another person (the agent) to make financial, medical, or legal decisions on your behalf. This legal document ensures your preferences are respected when you’re unavailable or unable to decide for yourself, or otherwise want another person to handle your affairs.

New Mexico POAs are governed by the Uniform Power of Attorney Act (Chapter 45, Article 5B, NMSA 1978). To be valid, the principal must sign before a notary public, as required by § 45-5B-105.

How To Write a Power of Attorney in New Mexico

Follow these steps to create a valid New Mexico power of attorney:

  1. Identify the parties: Include the full legal names and contact details of both the principal and agent. You may also name co-agents or successor agents under NM Stat § 45-5B-111.
  2. Define the authority: List the powers granted to your agent, such as handling financial transactions, property management, or healthcare decisions.
  3. Choose durability: A POA is durable by default in New Mexico unless stated otherwise (NM Stat § 45-5B-104).
  4. Add special instructions: You may limit your agent’s powers, include termination terms, or specify how gifts or property transfers should be handled.
  5. Sign before a notary: The principal must sign before a notary public to make the document valid (NM Stat § 45-5B-105).

Legal Requirements and Considerations for New Mexico POAs

Notarization

All POAs must be signed before a notary public to be enforceable. This requirement helps verify authenticity and prevent fraud (NM Stat § 45-5B-105).

Durability

Under NM Stat § 45-5B-104, a power of attorney remains effective even after the principal becomes incapacitated unless the document specifies it will end.

Revocation

You can revoke a POA at any time by signing a written revocation form and notifying your agent and any relevant parties (NM Stat § 45-5B-110). Divorce also terminates your spouse’s authority if they’re listed as your agent unless stated otherwise.

Filing

If your POA authorizes real estate transactions, it should be recorded in the county clerk’s office where the property is located to protect against future disputes.
