Durable vs. Non-Durable POAs in North Dakota

A non-durable power of attorney automatically ends if you become incapacitated or upon a specified end date. According to NDCC § 30.1-30-01, POAs in North Dakota are not automatically durable unless the document explicitly states otherwise.

Medical and Healthcare Power of Attorney

A North Dakota medical power of attorney (also known as a health care directive) allows your chosen agent to make medical decisions when you cannot. This is defined under NDCC § 23-06.5-01.

It can include preferences for treatment, long-term care, and end-of-life support. You can combine this document with a living will, which outlines your exact medical wishes. In North Dakota, these two documents are often merged into a single advance directive.

Financial Power of Attorney

You can create a valid North Dakota power of attorney by following these steps:

1. List the principal and agent: Include names, addresses, and contact information for both.
2. Choose the type of POA: Select whether it will be durable, medical, limited, or general.
3. Define authority and scope: Specify what actions your agent can take on your behalf.
4. Set the effective date: Decide whether the POA becomes effective immediately or only under certain conditions (like incapacity). POAs in North Dakota are durable by default and will not end upon the principal’s incapacity.
5. Sign and notarize (recommended): While North Dakota law doesn’t require notarization, doing so strengthens the document’s validity and helps prevent disputes.

Duration

Unless stated otherwise, a POA takes effect immediately upon signing. Durable POAs continue until revoked or the principal passes away, while POAs concerning minors last only up to six months.

Termination

A POA ends when the principal dies, the agent dies or becomes incapacitated, or the document’s terms expire. If your spouse is named as your agent, the POA automatically ends upon divorce or legal separation.

Revocation

Under NDCC § 30.1-30-04, you can revoke a POA at any time by creating a written revocation and notifying your agent and relevant institutions.

Filing

A POA doesn’t usually need to be filed. However, real estate POAs should be recorded with the county clerk’s office where the property is located.

Signing and Notarization

Although not required, notarization is strongly recommended. Having your POA notarized creates an official record that reinforces your intent and can prevent future challenges.
