What Is an Ohio Power of Attorney?

An Ohio power of attorney (POA) lets you appoint a trusted person, called an agent, to act on your behalf in personal, financial, or medical matters. This legal document ensures your affairs are managed according to your wishes if you’re unavailable or unable to act.

To create a valid POA in Ohio, the principal must be at least 18 years old and mentally competent at the time of signing.

Ohio POAs are governed by the Ohio Revised Code Chapter 1337, which outlines how to create, execute, and revoke powers of attorney.

Types of Power of Attorney in Ohio

Ohio recognizes several types of POAs designed for specific purposes. The table below summarizes each one and its signing requirements.

Durable vs. Non-Durable Power of Attorney

Under Ohio Revised Code § 1337.24, a POA is durable by default, meaning your agent’s authority continues even if you become incapacitated.

A non-durable power of attorney automatically ends if you lose mental capacity. It’s commonly used for short-term matters like signing documents while you’re away.

Medical Power of Attorney in Ohio

An Ohio medical power of attorney, or power of attorney for health care, allows your agent to make medical decisions when you can’t. According to OH Rev Code § 1337.11–1337.17, this includes:

  • Consenting to or refusing treatments
  • Deciding on pain management and medication
  • Selecting or dismissing healthcare providers
  • Making end-of-life decisions

A durable healthcare POA can act as an advance directive and is often paired with a living will to record your medical treatment preferences.

Financial Power of Attorney

A financial power of attorney grants your agent the ability to handle your monetary and property affairs. Under OH Rev Code § 1337.34, you may assign powers such as:

  • Managing bank accounts and investments
  • Handling real estate or business operations
  • Filing taxes and managing insurance policies
  • Overseeing personal or household finances

How To Write a Power of Attorney in Ohio

Follow these steps to create a valid Ohio POA:

  1. Identify the parties: List the principal and agent’s full names, addresses, and contact information. You can also name co-agents or successor agents.
  2. Grant authority: Choose which powers to assign—financial, legal, medical, or limited.
  3. Include specific instructions: Add limitations or special terms, such as when the POA becomes effective or ends.
  4. Set the effective date: Unless otherwise stated, the POA takes effect immediately upon signing (OH Rev Code § 1337.29).
  5. Sign and notarize: The principal must sign the document before a notary public. For healthcare POAs, two witnesses may substitute for notarization (OH Rev Code § 1337.12).

Ohio Power of Attorney Requirements and Legal Considerations

Notarization

Most Ohio POAs must be notarized to be valid under OH Rev Code § 1337.25. For medical POAs, you may use two witnesses instead.

Filing

Recording is not required unless the POA affects real estate. In such cases, it must be filed with the county recorder’s office per OH Rev Code § 1337.04.

Agent Certification

Agents can complete a certification under OH Rev Code § 1337.61 to verify their understanding of the duties and limitations of their role.

Revocation

You can revoke a POA at any time as described in OH Rev Code § 1337.30. Revocation occurs automatically upon your death, written notice, upon the principal’s incapacity in a non-durable POA, or fulfillment of the POA’s stated purpose.

If the POA was previously recorded, the revocation must also be recorded in the same office under OH Rev Code § 1337.05.
