Free Oklahoma Power of Attorney Template

An Oklahoma power of attorney (POA) lets you appoint a trusted person—called an agent—to make legal, financial, or healthcare decisions on your behalf. This document ensures that your affairs are managed if you become unable to act for yourself.

To create a valid POA in Oklahoma, the principal must be at least 18 years old and mentally competent.

You can use our state-compliant templates to grant as much or as little authority as you need. These documents are governed by Title 58 of the Oklahoma Statutes.

Oklahoma recognizes several types of POAs to fit different needs. The table below summarizes each one and its signing requirements.

Durable vs. Non-Durable Power of Attorney

A durable power of attorney stays in effect even if you become incapacitated. Oklahoma law refers to this as a durable designation of agent.

A non-durable power of attorney automatically ends if you can no longer make decisions for yourself.

Under 58 OK Stat § 3004, all POAs are presumed durable unless the document states otherwise.

Medical Power of Attorney in Oklahoma

An Oklahoma medical power of attorney (also called a power of attorney for health care) allows your agent to make medical decisions on your behalf. It typically takes effect when a doctor determines you’re unable to make decisions yourself.

This form lets your agent:

• Consent to or refuse medical treatment
• Choose healthcare providers
• Approve procedures or surgeries
• Sign a do-not-resuscitate (DNR) order

Your medical POA may also serve as an advance directive, expressing your end-of-life wishes. You can attach a living will to specify your preferred care instructions.

Financial Power of Attorney

A financial power of attorney authorizes your agent to manage your financial affairs, including:

• Banking and investments
• Real estate management
• Paying taxes and bills
• Handling personal property
• Managing retirement plans

Under 58 OK Stat §§ 3027–3039, you can choose which financial powers to grant and specify when they take effect.

Follow these steps to create a legally valid power of attorney in Oklahoma:

1. Name the parties: Include the principal’s and agent’s full legal names and contact information. You may also add co-agents or successors.
2. Grant general authority: Choose the powers you want your agent to have, such as managing finances, real estate, or healthcare.
3. Add specific powers: Certain powers—like making gifts, managing trusts, or changing beneficiaries—must be stated explicitly under 58 OK Stat § 3024.
4. Set the effective date: A POA becomes effective upon signing unless otherwise stated in your document (58 OK Stat § 3009). You can specify a start date or event for a springing POA.
5. Sign and notarize: Review your completed form and sign it before a notary. For medical POAs, two witnesses can substitute for notarization (63 OK Stat § 3101.4).

Notarization

Under 58 OK Stat § 3005, a power of attorney must be notarized to be legally valid. The principal’s signature and the date must appear on the document.

For medical POAs, two adult witnesses may replace notarization if they meet the criteria in 63 OK Stat § 3101.4.

Filing

Most POAs in Oklahoma do not need to be filed. However, if the POA concerns real estate, you must record it with the county clerk where the property is located.

Financial institutions, tax offices, or healthcare providers may also request a copy before recognizing the agent’s authority.

Agent Certification

Agents may complete an optional certification form under 58 OK Stat § 3042 to confirm they understand their powers and limitations. This helps clarify responsibilities and provides additional proof of authority.

Revocation

You can end a POA anytime by creating a revocation of power of attorney. According to 58 OK Stat § 3010, a POA ends when:

• You revoke it in writing and deliver notice to your agent.
• The purpose of the POA is fulfilled.
• The agent resigns or becomes unable to serve (58 OK Stat § 3018).
• You become incapacitated (if the POA is non-durable).
• You or your spouse (if they’re your agent) divorce or legally separate, unless the document provides otherwise.
