An Arkansas real estate power of attorney form appoints an agent to handle real property on your behalf, including conveying it. The Arkansas Uniform Power of Attorney Act, chapter 68 of Title 28, governs powers of attorney generally, and Title 18 adds rules for conveying real estate.

Two sets of rules apply when the power covers real estate.

Who Signs

Under section 28-68-105, the principal signs, or another person signs the principal’s name in the principal’s conscious presence and at their direction.

Notarization Creates a Presumption

A signature is presumed genuine if the principal acknowledges it before a notary public or other person authorized to take acknowledgments.

Acknowledged and Recorded for Conveyances

Section 18-12-501 says a power of attorney containing a power to convey real estate, or to sign a deed affecting real estate, must be acknowledged or proved, certified, and recorded with the deed the agent makes under it.

What Real Property Authority Covers

Under section 28-68-204, general authority over real property lets the agent acquire or lease property, sell, exchange, or convey it, and pledge or mortgage it as security for a loan.

Yes, when it’s used to convey real estate. Section 18-12-501 requires the power of attorney to be acknowledged or proved, certified, and recorded with the deed your agent signs.

The acknowledgment must be taken by the same courts or officers authorized to take acknowledgments of deeds conveying real estate.
