What Is a Real Estate Power of Attorney in Hawaii?

A Hawaii real estate power of attorney form appoints an agent to handle real property matters for you. Hawaii’s Uniform Power of Attorney Act, chapter 551E of the Hawaii Revised Statutes, governs it.

Hawaii Requirements for a Real Estate Power of Attorney

Section 551E-3 sets the core rules.

Durable by Default

A power of attorney created under chapter 551E is durable unless it expressly says it ends if the principal becomes incapacitated.

Who Signs

The principal signs, or another person signs the principal’s name in the principal’s conscious presence and at their direction.

Acknowledgment Creates a Presumption

A signature is presumed genuine if the principal acknowledges it before a notary public or another person authorized to take acknowledgments. Section 551E-15 lets people who accept an acknowledged power of attorney in good faith rely on that presumption.

The Statutory Form

A statutory form appears in section 551E-51. You initial each subject you want to include in the agent’s general authority, or initial a line covering all of them.

Does a Hawaii Real Estate Power of Attorney Form Need to Be Notarized?

Section 551E-3 doesn’t require it for the document to be signed validly. It requires the principal’s signature, or a signature made at their direction and in their conscious presence.

Acknowledging the signature before a notary adds a presumption that it’s genuine, and section 551E-15 builds its reliance rules around acknowledged documents.

Tip: Have your Hawaii real estate power of attorney form acknowledged before a notary. The act’s reliance protections are written for acknowledged documents.
