What Is a Real Estate Power of Attorney in Kentucky?

A Kentucky real estate power of attorney form appoints an agent to convey or release real property for you. Kentucky’s Uniform Power of Attorney Act, KRS Chapter 457, governs execution, and KRS 382.370 covers recording a power used to convey property.

Kentucky Requirements for a Real Estate Power of Attorney

Both chapters apply when the power covers real estate.

Who Signs

Under KRS 457.050, the principal signs, or another person signs in the principal’s conscious presence at their direction. If someone else signs, the reason must be stated in the power of attorney.

Acknowledgment Creates a Presumption

A signature is presumed genuine if the principal acknowledges it before a notary public or another person authorized to take acknowledgments.

Recorded Like the Deed

Under KRS 382.370, if a conveyance made under a power must be recorded to be valid against creditors and purchasers, the power must be recorded the same way.

Revoking a Recorded Power

A recorded power isn’t treated as revoked until a written revocation, executed and acknowledged as for conveyances, is lodged in the office where the power is recorded.

The County Clerk’s Filing Rules

The Kenton County Clerk lists filing requirements for a power of attorney to convey or release property, including the grantor’s signature and notarized signatures.

Does a Kentucky Real Estate Power of Attorney Form Need to Be Recorded?

Yes, when it’s used for a conveyance that must be recorded. KRS 382.370 requires the power to be recorded in the same manner as that conveyance.

The county clerk’s filing requirements for these powers mirror those for recording a deed, so plan on notarization.

Tip: Have your Kentucky real estate power of attorney form notarized when you sign it, so it meets the county clerk’s filing requirements.
