What Is a Real Estate Power of Attorney in Maryland?

A Maryland real estate power of attorney form appoints an agent to handle real property matters for you. The Maryland General and Limited Power of Attorney Act, Title 17 of the Estates and Trusts Article, governs it.

Maryland Requirements for a Real Estate Power of Attorney

Section 17-110 lists four requirements for a power of attorney executed on or after October 1, 2010.

In Writing and Signed

It must be in writing and signed by the principal, or by another person in the principal’s presence at their express direction.

Acknowledged Before a Notary

The principal must acknowledge it before a notary public.

Two Adult Witnesses

Two or more adult witnesses must attest and sign it, in the principal’s presence and each other’s. The notary may also serve as one of the witnesses, with limits when notarizing remotely.

Executed Like a Deed for Real Estate

Maryland’s People’s Law Library notes that a power of attorney authorizing certain real estate transactions must be executed the same way as a deed and recorded, under Real Property section 4-107.

Electronic Powers

Section 17-110 sets extra requirements for electronic or remotely witnessed powers of attorney, with a separate rule for an electronic power used in a real estate transaction.

Does a Maryland Real Estate Power of Attorney Form Need Witnesses?

Yes. Section 17-110 requires two or more adult witnesses in addition to the notary acknowledgment, and the notary may count as one of them.

For certain real estate transactions, the power of attorney must also be executed like a deed and recorded under Real Property section 4-107.

Tip: Arrange your notary and at least one more adult witness for the same appointment when you sign a Maryland real estate power of attorney form.

How to Complete a Maryland Real Estate Power of Attorney Form

Plan the signing with everyone present:

  1. Name yourself as principal and your agent.
  2. Identify the property and the powers you grant.
  3. List any limits on the agent’s powers.
  4. Sign in front of a notary and two adult witnesses.
  5. Have the witnesses attest and sign.
  6. Record it if your agent will use it for a real estate transaction that requires recording.
