What Is a Real Estate Power of Attorney in Utah?

A Utah real estate power of attorney form appoints an agent to handle real property for you. Utah’s Uniform Power of Attorney Act, Title 75A, Chapter 2 of the Utah Code, governs it as of September 1, 2024.

Utah Requirements for a Real Estate Power of Attorney

Chapter 75A-2 sets these rules.

Signed Before a Notary

Under section 75A-2-105, a principal may sign a power of attorney, or direct someone in their conscious presence to sign, if it is signed before a notary public or another person authorized to take acknowledgments.

Mental Capacity

The principal must also have enough mental capacity at signing to understand they are appointing an agent to handle their financial affairs.

Real Property Authority

Section 75A-2-204 says general authority over real property lets the agent, among other powers, acquire or reject an interest in real property, unless the power of attorney provides otherwise.

Copies for Real Property Transactions

A photocopy or electronically transmitted copy of a power of attorney has the same effect as the original. For real property transactions, the copy may be recorded in the county where the transaction lies when attached to an affidavit of the person accepting the power.

Does a Utah Real Estate Power of Attorney Form Need to Be Notarized?

Yes. Section 75A-2-105 conditions the principal’s signing on it being signed before a notary public or another person authorized to take acknowledgments.

The act also eases recording. A copy may be recorded for a real property transaction when attached to the accepting person’s affidavit.

Tip: Sign your Utah real estate power of attorney form at the notary, not beforehand, since the statute ties signing to the notary’s presence.
