Free Virginia Real Estate Power of Attorney Form Template

A Virginia real estate power of attorney form appoints an agent to handle real property for you. Virginia’s Uniform Power of Attorney Act, Chapter 16 of Title 64.2 of the Code of Virginia, governs it, and Title 55.1 covers recording.

Section 64.2-1603 sets the execution rule and ties recording to Title 55.1.

Who Signs

The principal signs, or another person signs the principal’s name in the principal’s conscious presence at their direction.

Acknowledgment Creates a Presumption

A signature is presumed genuine if the principal acknowledges it before a notary public or another person authorized to take acknowledgments.

Recordable Only if Section 55.1-600 Is Met

To be recordable, a power of attorney must satisfy the requirements of section 55.1-600, which governs recording writings in the clerk’s office.

Recordable in Any County or City

Title 55.1 provides that a power of attorney may be recorded in any county or city.

Acceptance Within Seven Business Days

A person asked to accept an acknowledged power of attorney must accept it, or request a certification, translation, or opinion of counsel, within seven business days.

For recording, plan on it. Section 64.2-1603 makes a power of attorney recordable only if it satisfies section 55.1-600, which lets the clerk record a writing once it is acknowledged or proved.

Acknowledgment also brings the act’s acceptance rules, which apply to acknowledged powers.
