What Is a Rhode Island Power of Attorney?

A Rhode Island power of attorney (POA) allows you (the principal) to authorize another person (the agent) to act on your behalf in personal, financial, or healthcare matters. It ensures your affairs continue to be managed even when you can’t handle them yourself.

To create a POA, the principal must be at least 18 years old and mentally competent. Under RI Gen L § 34-22-8, individuals aged 17 who are in active military service during wartime may also create one.

Rhode Island’s power of attorney laws are based on the Rhode Island Short Form Power of Attorney Act rather than the Uniform Power of Attorney Act adopted by many states.

How to Write a Power of Attorney for Rhode Island

You can create a valid Rhode Island POA using the state’s statutory short form or a customizable template. Follow these steps:

  1. Identify the principal and agent: Include your full legal name and your agent’s name, address, and contact details.
  2. Specify authority: List which powers your agent will have—such as managing bank accounts, real estate, or healthcare decisions—and note any restrictions.
  3. Choose durability: Rhode Island POAs are not durable by default. To keep them effective after incapacity, include language explicitly stating that the POA remains valid if you become incapacitated (RI Gen L § 18-16-2).
  4. Define effective and termination dates: State when the POA takes effect and whether it ends automatically or remains ongoing.
  5. Sign and notarize: The principal must sign before a notary public to validate the document.

Legal Requirements and Considerations for Rhode Island POAs

Execution and Notarization

All Rhode Island POAs must follow the form requirements in the Rhode Island Short Form Power of Attorney Act. The principal must acknowledge their signature before a notary.

Duration

A POA becomes effective once signed unless it specifies a later date or event. It remains valid until revoked, terminated, or the principal dies.

Revocation

You can revoke your POA at any time by completing a notarized revocation of power of attorney and providing copies to your agent and any organization relying on the previous document.

Termination

A Rhode Island POA ends when:

  • The principal or agent dies
  • The principal revokes it
  • Its termination conditions are met
  • The agent resigns or becomes incapacitated
  • A court orders termination
  • The principal becomes incapacitated (for a non-durable POA)

Divorce may also terminate a spousal POA unless otherwise stated in the form.
