Free Utah Motor Vehicle Power of Attorney Template

A Utah motor vehicle power of attorney appoints an agent to handle title and registration matters for your vehicle. Utah’s Uniform Power of Attorney Act sets how it must be signed, now found at Utah Code section 75A-2-105.

The execution rule moved in 2024. It was renumbered from section 75-9-105 to section 75A-2-105, effective September 1, 2024.

Signed Before a Notary

A principal may sign a power of attorney, or direct someone in their conscious presence to sign their name, if it is signed before a notary public or another person authorized to take acknowledgments.

Mental Capacity at Signing

The principal must also have enough mental capacity at signing to understand they are appointing an agent to handle their financial affairs. Section 75A-2-105 adds that understanding how the agent will manage those affairs is not required.

Acknowledged Signatures Are Presumed Genuine

A signature on a power of attorney is presumed genuine if the principal acknowledges it before a notary or other authorized person.

The DMV Checks ID

On a title transfer, the DMV says all owners listed on the title application must provide government-issued identification.

Yes, under section 75A-2-105. The principal may sign if the power of attorney is signed before a notary public or another person authorized to take acknowledgments.

That notary step also gives the document the statutory presumption that the signature is genuine.

Tip: Sign your Utah motor vehicle power of attorney at the notary, not beforehand. The statute’s rule is that it is signed before a notary or other authorized official.

Plan the signing with the notary:

1. Name yourself as principal and your agent.
2. Describe the vehicle, including the VIN.
3. State the title and registration acts your agent may perform.
4. Sign in front of a notary, or direct someone to sign for you in your presence.
5. Have the notary complete the acknowledgment.
6. Give the signed original to your agent for the DMV.

Keep it specific:

• Principal’s and agent’s names and addresses
• Vehicle year, make, and VIN
• The title and registration acts authorized
• Principal’s signature and date
• A notary’s acknowledgment
