What Is a Washington, DC Power of Attorney?

A Washington, DC, power of attorney (POA) allows you (the principal) to authorize someone else (the agent or attorney-in-fact) to handle specific legal, financial, or medical matters on your behalf.

It’s often used for estate planning or emergency preparation so your chosen representative can act if you’re unavailable or incapacitated. For example, they can pay bills, sell property, or make healthcare decisions consistent with your wishes.

Under the Uniform Power of Attorney Act, a DC power of attorney is durable by default unless it specifically says it ends upon incapacity (DC Code § 21-2601.04).

To be valid, it must be signed and acknowledged before a notary as required by DC Code § 21-2601.05.

How To Write a Power of Attorney for Washington, DC

You can create a valid DC power of attorney without a lawyer by following these steps:

  1. Identify the parties: Include the full names and contact details of the principal and agent. You may name co-agents or successors.
  2. Define the authority: Specify which powers the agent can exercise, such as handling finances, property, or health decisions.
  3. Choose durability: DC law presumes durability unless the POA explicitly states it ends at incapacity (DC Code § 21-2601.04).
  4. Set timing: Make it effective immediately or only upon a trigger (for a springing POA). Unless otherwise provided, the POA becomes effective the day it is signed.
  5. Add special terms: Limit powers, exclude certain actions, or include gift restrictions.
  6. Sign and notarize: The principal must sign or direct someone to sign in their conscious presence, then acknowledge the document before a notary (DC Code § 21-2601.05).

Legal Requirements and Considerations for Washington, DC POAs

To be valid, a DC POA must comply with the Uniform Power of Attorney Act and execution standards in DC Code § 21-2601.05.
For health-related POAs or advance directives, follow witness rules in DC Code § 21-2205.

Duration

Unless stated otherwise, a DC POA becomes effective when signed and remains in effect indefinitely.
It is durable by default unless you expressly state it ends when the principal becomes incapacitated (DC Code § 21-2601.04).

Termination

Under DC Code § 21-2601.10, a POA ends when:

  • the principal or agent dies,
  • the agent resigns or becomes incapacitated,
  • the principal revokes the POA,
  • a court declares the POA invalid, or
  • the document ends by its own terms.

If your agent is your spouse, the POA automatically terminates upon divorce or legal separation unless stated otherwise.

Revocation

To revoke a DC power of attorney, prepare and sign a revocation document, then notify your agent and any institution relying on it. Until notification is received, the agent may continue to act under the original POA. You can use a Washington, DC POA revocation form to handle this properly.

Filing and Recording

Most POAs don’t need to be filed, but a real estate POA should be recorded with the DC Recorder of Deeds. Providing copies to banks, hospitals, and agencies ensures your agent’s authority is recognized without delay.
