What Is a Colorado Residential Purchase Agreement?

A Colorado residential purchase agreement is the contract where a buyer and seller agree on a home’s price, conditions, and closing date. The details you settle here feed two pieces of closing paperwork: a small recording fee and a sales declaration for the county assessor.

Colorado Paperwork That Comes With a Sale

Colorado keeps its closing costs modest, but the paperwork still needs care. Your Colorado residential purchase agreement should line up with both items below.

The Documentary Fee

Anyone recording a deed that grants or conveys Colorado real property pays a documentary fee to the county clerk and recorder (C.R.S. § 39-13-102). No fee is due when the total consideration is $500 or less.

Above $500, the fee is one cent for each $100 of consideration, or major fraction of $100. Consideration includes any lien the buyer takes on and the charges needed to make the transfer. On a $400,000 sale, that comes to $40.

Fees can change, so confirm the amount with your county clerk and recorder before closing.

The Real Property Transfer Declaration

A Real Property Transfer Declaration, form TD-1000, must accompany conveyance documents subject to the documentary fee when they’re presented for recording. Either the seller or the buyer completes and signs it (C.R.S. § 39-14-102).

The declaration isn’t recorded. It’s kept confidential and gives the county assessor market information for fair, uniform property assessments.

What Happens If You Skip the TD-1000 in Colorado?

The county assessor may send a notice asking for it. Then the clock starts. If the signed declaration doesn’t arrive within 30 days of that notice, the assessor may impose a penalty of $25 or 0.025% of the sale price, whichever is greater.

On a $600,000 home, that’s a $150 penalty. Filing the TD-1000 alongside the deed avoids the problem entirely.

List any personal property included in the sale, like furniture or major appliances, with an approximate value. If the TD-1000 lists none, the assessor treats the entire price as paid for the real property.

How to Complete a Home Sale in Colorado

Here’s how a Colorado sale usually wraps up.

  1. Agree on terms and sign. Buyer and seller both sign the Colorado residential purchase agreement.
  2. List what’s included. Note any furniture, equipment, or other personal property that comes with the home, plus its approximate value.
  3. Prepare the TD-1000. A title company or closing agent may prefill the first questions, and the signer should confirm them before signing.
  4. Pay the documentary fee. The county clerk and recorder collects it when you present the deed.
  5. Submit for recording. Present the deed together with the completed declaration.
