Free Kansas Residential Purchase Agreement Template

A Kansas residential purchase agreement is the signed contract that sets a home’s price, conditions, and closing date. Many of its details reappear later on a state questionnaire that has to accompany the deed.

One Kansas form stands between a signed deed and the public record. Keep your Kansas residential purchase agreement detailed enough to complete it.

The Sales Validation Questionnaire

The register of deeds can’t record a deed or instrument transferring title to real estate without a completed real estate sales validation questionnaire (K.S.A. 79-1437c). Either the seller, the buyer, or an agent of either completes it.

Kansas’s director of property valuation designs the questionnaire and supplies copies to registers of deeds. In counties the director approves, the register may accept a shorter one-part version.

What Happens to It

Unlike the deed, the questionnaire doesn’t become part of the public record. Instead, the office keeps it for five years and then destroys it. The register of deeds and county clerk use its information to help the state’s director of property valuation.

Answer Every Question

In practice, the Kansas Department of Revenue tells registers of deeds to confirm every question has an answer. Its instructions say to date the questionnaire with the day of signing for the deed or contract for deed, not the recording date. Sign it and include a daytime phone number.

Not for an ordinary sale. The statute bars recording without a completed questionnaire.

Certain transfers are exempt, such as a gift stated in the deed. Even then, the exemption has to appear clearly on the deed itself. According to the Department of Revenue’s instructions, the register of deeds can’t add that exemption note at filing.

A Kansas sale usually wraps up like this.

1. Finalize terms. Seller and buyer put their signatures on the Kansas residential purchase agreement.
2. Get the deed ready. Your closing agent drafts it for signing.
3. Complete the questionnaire. Answer every item and sign it with a daytime phone number.
4. Note any exemption on the deed. Only if the transfer qualifies.
5. Submit to the register of deeds. File the deed together with the questionnaire.
