Free Colorado Quitclaim Deed Template

A Colorado quitclaim deed conveys whatever interest the grantor holds in a property to the grantee, with no warranty of title. The grantee takes on only the interest the grantor currently holds.

Since it makes no title promises, a quitclaim usually appears between parties who already trust each other, such as spouses, co-owners settling a share, or an owner funding a trust.

A Colorado quitclaim deed is effective between the parties on signing, but it must meet state rules before the county clerk and recorder will accept it. Recording is what tells the public that ownership has changed.

Signing and Notarization

The grantor signs the deed and has it acknowledged by a notary. Colorado requires a conveyance of real property to be acknowledged so the clerk and recorder can enter it in the land records.

Recording and Transfer Tax

Record the signed, notarized deed with the county clerk and recorder in the county where the property is located. Colorado applies a documentary fee to real property conveyances above a set value threshold, so confirm the current fee and whether your transfer is subject to it with that office.

Tip: A quitclaim delivers only the grantor’s existing interest, and warrants nothing. When money changes hands in an arm’s-length sale, a general warranty deed usually serves better, so decide which deed fits first.

With the county clerk and recorder. File your signed, notarized Colorado quitclaim deed with the clerk and recorder in the county where the property sits, and it enters the public land records.

Recording protects the grantee against competing claims to the same interest. If the title raises any questions, talk with a Colorado real-estate attorney before you record.

Gather these details so the clerk and recorder can process the deed without a return.

• Grantor and grantee names and addresses.
• The legal description of the property.
• The consideration, if any, exchanged.
• Preparer name, return address, and a notary block.
