A property management agreement is a contract between a property owner and a property manager (or management company). It gives the manager written authority to handle agreed-upon tasks for the property, such as finding tenants, collecting rent, coordinating repairs, and sending owner reports.

Because rental rules vary by location, your agreement should also reflect the basics of landlord-tenant law, including how leases, repairs, and tenant issues are typically handled.

A property management agreement is different from a lease. The lease is between the owner and the tenant. This agreement is between the owner and the manager who helps run the property.

What a Property Manager Typically Handles

Every property is different, so the scope should match your needs. Many agreements include responsibilities like:

• Tenant placement: Advertising the unit, screening applicants, and preparing lease paperwork.
• Rent collection: Collecting rent, tracking payments, and following up on late rent.
• Maintenance coordination: Scheduling repairs, managing vendors, and documenting work completed.

• Owner payout schedule: When you’ll receive rent proceeds after expenses.
• Authorized repair limit: A spending cap for non-emergency repairs without owner approval.
• Emergency rules: What counts as an emergency and how approvals work after-hours.
• Reserve fund: Whether the manager holds a small reserve to cover urgent repairs.

Reporting and Communication

Set expectations for updates so you’re not guessing what’s happening.

• Monthly reporting deadline: When statements and receipts will be delivered.

Term, Renewal, and Termination

1. Choose the State and Property Type

Start with the state where the property is located, then identify whether the property is residential, commercial, or mixed-use. This helps you tailor the language and expectations to the rental environment you’re in.

2. Define the Manager’s Authority

Be direct about what the manager is allowed to do without asking first. For example, can they:

• Sign leases or renewals on your behalf?
• Approve repairs up to a dollar limit?
• Serve notices to tenants?
• Hire and manage vendors?

Tip: Licensing rules can change by state. For example, Florida regulates certain real estate activities through state law, with defined exceptions and requirements. If your manager will lease units or handle rent collection, check your state’s licensing rules before you sign.

3. Set Clear Leasing and Tenant Rules

If the manager handles leasing, include the basics of how that process should work:

• How vacancies will be marketed, and where listings will appear.
• Minimum screening standards you want applied consistently.
• Lease terms the manager may offer, such as 12 months or month-to-month.

When the manager signs or prepares leases, a strong lease agreement keeps the owner and tenant relationship clear from day one.

4. Decide How Repairs and Emergencies Will Work

Most owners want two things at once: quick fixes for real problems and control over big spending. You can get both by writing repair rules clearly.

• Set a spending cap for non-emergency repairs without owner approval.
• Define what qualifies as an emergency, such as active leaks, no heat in winter, or safety hazards.
• Explain how the manager will notify you and document the work.

5. Spell Out Compensation and Payment Handling

List every fee you expect to pay, and when it applies. Also explain how rent will flow through the manager to you, including:

• When owner payouts occur each month.
• What expenses can be paid from collected rent.
• Whether a reserve fund is held, and how it is replenished.

6. Add Reporting Requirements

Reporting keeps the relationship healthy. Include a simple monthly reporting schedule, plus any event-based reporting you want, such as notifying you when:

• A tenant gives notice to vacate.
• A major repair is needed.
• A tenant is late or in breach of the lease.

If a tenant stops paying rent and legal steps become necessary, having documentation ready helps. Your manager may also use notices like a late rent notice or an eviction notice, depending on your state’s required process.

7. Finalize the Term and Exit Process

Finally, decide how either party can end the agreement, and what happens immediately after termination. A clean exit clause should cover returning keys, handing over records, and transferring vendor accounts.

Property management agreements can be short or long, depending on the property and the relationship. Some owners prefer a shorter initial term, while others choose a longer period for stability.

What matters most is that the agreement clearly states:

• Whether the term is fixed: A set start and end date.
• How renewal works: Automatic renewal or a new signed agreement.
• How termination works: Notice requirements and exit duties.

If the agreement includes automatic renewal, make the notice period easy to follow. It should be clear who must give notice, how notice must be delivered, and when it must be received.

Once your agreement is signed, you’ll usually want to set up a smooth handoff so the manager can start working without delays.

• Share key documents: Current leases, rules, tenant contact info, and maintenance history.
• Confirm communication preferences: Email, phone, and how approvals should be documented.
