Free Rent Increase Notice

You can raise the rent, but the timing depends on the type of lease:

• Fixed-term lease: Rent usually can’t change during the term unless the lease allows it or the tenant agrees. Otherwise, you must wait until renewal.
• Month-to-month lease: Rent can be raised with proper written notice, often 30 days in advance.

If there’s no formal lease in place, you still need to give written notice. This includes situations like at-will tenancies or rooming house rentals where tenants pay weekly.

Most states require at least 30 days’ notice. Some require more time, depending on how much the rent is increasing or how long the tenant has lived there.

Here are examples:

California: Under the Tenant Protection Act of 2019 (AB 1482)

• 30 days’ notice for rent increases of 10% or less

• 90 days’ notice for increases over 10% (CA Civ Code § 827).

Exemptions: Single-family homes (with proper notice) and properties built in the last 15 years are not covered.

Maine: 45 days for increases less than 10% or 75 days for increases more than 10% of the total rent previously charged.

There is no federal limit on rent increases, and most states also don’t set a cap unless rent control or stabilization laws apply. That said, large increases can cause tenants to move or challenge the notice, especially if the rent is much higher than nearby listings.

Some landlords follow these general guidelines:

• 1–2% annually to match inflation
• 3–5% if local rates are climbing or costs have gone up
